Payment Fraud Counseling and Litigation

Payment fraud continues to evolve as financial institutions face increasingly sophisticated schemes and heightened regulatory expectations. We defend our banking clients against fraud-related claims and help establish protocols to prevent future occurrences. We also pursue claims on behalf of our banking clients to recover losses from various types of fraud, including check fraud, ACH fraud, wire transfer fraud, and other unauthorized transactions.

Our knowledge of UCC Articles 3, 4, and 4A allows us to defend and pursue claims on behalf of banking clients in disputes over forged instruments, altered checks, and unauthorized wire transfers. We also advise on compliance with Regulation E (Electronic Fund Transfer Act) and Regulation CC (Funds Availability).

In addition to representing clients in fraud-related disputes, we work proactively with financial institutions to strengthen their policies, procedures, and documentation. We develop and refine fraud affidavit forms, customer account agreements, and train our banking clients on internal response procedures to minimize liability exposure and streamline responses to fraud claims. By combining litigation experience with practical counseling, we help financial institutions address today's fraud challenges while positioning them to respond effectively to those that may arise in the future.
