Creditors' Rights & Bankruptcy

Bowles Rice is a full-service creditors’ rights, bankruptcy and restructuring law firm.  We advise clients in a wide array of industries, including financial services, energy, real estate, health care, and law firms.  To provide comprehensive representation for our clients, we work with our clients at the initial stage of credit transactions to create, perfect and preserve creditors’ liens and other rights, and avoid uncertainty and dispute when trouble befalls the debtor.  Proper drafting and review of credit instruments and agreements serves to ensure that our clients receive the full benefit of the protection for which they have bargained.

When disputes do arise, we provide comprehensive representation in commercial litigation involving legal issues arising out of complicated financial transactions, such as lender liability actions, bankruptcy proceedings and business disputes.  We vigorously enforce the collection rights and security interests of our creditor clients.  We will assist in negotiating workouts with troubled debtors, prosecuting collection actions in state and federal courts, enforcing liens on real and personal property, and standing as the creditor’s advocate in the entire array of bankruptcy litigation and reorganization disputes.

Our team members frequently appear in bankruptcy and other federal courts throughout West Virginia and neighboring states, in addition to appearances in state court enforcement actions.

In the 2018 edition of U.S. News & World Report's "Best Law Firms," Bowles Rice ranks as First Tier in more than 40 areas of law in West Virginia, including Banking and Finance Law, Bankruptcy and Creditor Debtor Rights / Insolvency and Reorganization Law, Commercial Litigation, Financial Services Regulation Law and Litigation – Banking and Finance / Bankruptcy.
