Bowles Rice has considerable experience practicing before the Public Service Commission of West Virginia on a host of issues.  Our attorneys have represented clients in rate and complaint cases before the Public Service Commission of West Virginia, both on behalf of the regulated utility and on behalf of other parties.  We have also negotiated on behalf of public utilities and customers with regard to agreements for service. Members of our firm actively participated in the electric utility deregulation meetings and Commission proceedings on behalf of industrial and residential consumers of power and have  participated in electric utility rate cases on behalf of industrial customers and competitors of the utility. 

Bowles Rice also participated in the development of siting certificate regulations for exempt wholesale generators on behalf of its electricity generation clients.  We has been successful in obtaining siting certificates from the PSC for exempt wholesale electricity generators, both coal-fired electric generation facilities and wind turbine projects.  These types of proceedings are always controversial and require familiarity and experience with environmental, safety, aesthetics, health and general welfare issues and the ability to coordinate concurrent environmental permitting proceedings from other regulatory agencies.

Our attorneys have considerable experience in preparing and submitting rate case proceedings to the Commission, including the preparation and submission of pre-filed and rebuttal testimony, the exchange of information among the parties, the negotiation of the matter with the Consumer Advocate and other parties, and ultimately, if negotiations are not successful, the presentation of the case to the Public Service Commission.  The successful presentation of these cases requires a combination of technical skill and political judgment and our attorneys have been skillful advocates for our clients in these types of proceedings.

Bowles Rice has represented a number of clients in formal complaint work before the Commission. Our philosophy encourages resolution of issues between parties if possible and desirable.  However, in the event a resolution is unattainable, Bowles Rice is a strong advocate of its client before the administrative law judge assigned to the case.
