Phyllis M. Potterfield

Phyllis Potterfield concentrates her practice in the areas of product and premise liability, toxic torts and medical monitoring defense and in the defense of related workers’ compensation claims. 

In 1981, after serving for five years as a law clerk and administrative counsel to the Louisiana Supreme Court, she returned to her native West Virginia, where she has represented national and regional chemical, manufacturing, coal and construction companies in both West Virginia state and federal courts, and before Workers’ Compensation Office of Judges and Board of Review. Her experience extends to litigation involving single and multiple plaintiffs, as well as class actions, and has led to extensive knowledge about occupational and other latent diseases and expertise in the selection and preparation of medical, industrial hygiene and toxicological witnesses.

  • Representation of manufactures in product, premise and worker liability cases involving dioxin, PCBs, PAB, benzene, TCE, acrylamide and other chemical compounds

  • Member of litigation team in the defense of a medical monitoring and property damage class action with over 10,000 putative class members, including the design of medical monitoring settlement plan

  • Substantial experience appearing in West Virginia workers’ compensation claims before the Occupational Pneumoconiosis Board

  • Helped draft the 2003 Business Coalition Workers’ Compensation reform legislation, which later led to the privatization of the West Virginia workers’ compensation system and significant decreases in workers’ compensation premiums for most West Virginia employers
